City to look at legal basis of Olanolan's salary request

DAVAO City Administrator Wendel E. Avisado said Wednesday the city would still have to look into the legal basis of the salary request of former barangay captain Robert E. Olanolan.

Olanolan has requested the City Government to grant the salary of barangay officials and workers under his chairmanship.

Outgoing barangay secretary Nancy Cortez said around 500 barangay workers have yet to receive their salaries from April to November this year.

In an interview Monday, Cortez said the city should give them what is due to them for the services they have rendered.

"Kung unsa ilang desisyon ila na, and all that we will do if its in accordance with the law, why not," said Avisado.

Avisado said barangay workers should forward their salary request to the City Legal Office to know if there is a legal basis.

"We cannot arrogate to ourselves the power of the right to determine how many are them should receive salary from this period to that period. All we have to do is precisely to look into the legal basis of the action of the barangay and as soon as we find out that there is legal basis to pay, then we will pay," he said.

Meanwhile, City Legal Officer Melchor Quitain said the city still have to wait the Court of Appeals decision before acting on Olanolan's request.

Quitain said Olanolan earlier petitioned the Regional Trial Court (RTC) to compel the City Government to release the allegedly unpaid salaries of the barangay workers.

"But the case was dismissed by the RTC, they also filed for a motion for reconsideration but the same was denied," Quitain said.

He added that Olanolan further brought the matter to the Court of Appeals claiming that the court acted in excess of its jurisdiction when it dismissed the case. (BRQ)
