Man, gay sued for street sex
THE City Prosecutor's Office has formally recommended the filing of charges against a self-confessed gay and a 24-year-old man for allegedly engaging in oral sex in an alley along Magallanes Extension, Davao City, Monday.
Prosecutor Retrina E. Fuentes recommended the filing of grave scandal against Michael (true name withheld for being a minor), 17, and one Flash Gordon, 24, a resident of Barangay 31-D, Mabini, Quezon Boulevard.
SPO1 Eduardo Escuardo of the San Pedro police precinct executed an affidavit saying he was at the community outpost along Magallanes Extension at around 10 p.m. when he was informed by a resident about two men having sex in an alley just a few meters from the outpost.
He went to the place to check and saw the two engaged in the scandalous activity. He said the alley was dimly lighted but passersby could see what the two were doing.
He arrested the two and brought them to the San Pedro Police Precinct.
Fuentes in her resolution said grave scandal should be forwarded in court since such charge is defined as "consisting of acts, which are offensive to decency and good customs, and which having been committed publicly, have given rise to public scandal to persons who have accidentally witnessed the same."
The prosecution recommended a bail of P2,000 each for the respondents' temporary liberty. Both are now detained at the San Pedro Police Precinct. (JGRS)
