Woman sued over bogus land deal By Joy Romares-Sevilla
THE City Prosecutor's Office has formally recommended the filing of charges against a woman accused of defrauding another by offering subdivision lots and making her victim believe that she is a managing partner of a land development company, five years ago.
Prosecutor Fundador B. Villafuerte Jr. recommended the filing of estafa charges against Erlinda Umalay, of legal age and a resident of Matina Pangi, who claimed to be a managing partner of the Greenville EBJ Land Development Corporation.
In her affidavit, complainant Socorro Pueblo of San Lorenzo Village in Puan said she met Umalay sometime in November 2001.
Umalay, she said, introduced herself as a managing partner of the Greenville EBJ Land Development Corporation -- a firm allegedly engaged in the business of developing subdivision lots.
Pueblo claimed that Umalay told her the firm is registered as a subdivision developer with license to sell. She added that Umalay even showed a certification of the Articles of Partnership of Greenville EBJ Land Development Corporation issued by the Security and Exchange Commission.
Pueblo said she was enticed to buy two lots at Catalunan Pequeño that cost P26,000 each.
She added that she made a total payment of P88,000 to Umalay for the two lots including the fees for the lot equity, membership, survey and others.
She said she followed up about the titles of the lot she bought, but was told by Umalay that the titling of the lots is being processed.
In July 2003, Pueblo said she checked with the SEC and discovered that Umalay's company is not registered as a subdivision developer and that SEC has never issued a license to sell.
She then reported the incident to the Talomo police precinct leading to the filing of the case.
