Illegal termination tops list of cases at labor agency

ILLEGAL termination of workers tops the lists of cases handled by the National Labor Relations Commission (NLRC) from January to November this year.

NLRC-Southern Mindanao executive labor arbiter Elbert C. Restauro said the cases filed before the office are mostly of those who are illegally terminated from work and with various claims.

"Mostly of the cases, money claims of workers and involved more than P5,000 of the claims. Others are those with no SSS, 13th month pay, and others," Restauro said.

He said their office thrusts are aimed towards settlement and mediation between the employer and employees.

The NLRC has mediated more than 41 percent of the total cases filed.

After the filing of the case, he said, the complainant will be made to choose on ho of the five arbiters will handle the case.

He said in cases where employers refused to conform, they will be forced to issue final execution.

Re-opened and re-filed

Meanwhile, disposed cases at the NLRC may be re-opened and re-filed by the worker-complainant if the employer refused to comply with the standards.

"Usually, if the case has no merit or the complainant lost interest of the case, it will be dismissed but can be re-filed," Restauro said.

The five arbiters of the office are handling five to seven cases a day.

Restauro added that since cases in NLRC are specialized, as all are labor cases, such are being resolved the soonest possible time.

The NLRC also caters to unfair labor practices, illegal dismissal damages, and overseas Filipino workers money claims in respective agencies. (RMH)
