Non-remittance of SSS sends man to jail
THE Regional Trial Court sentenced an employer to six years in jail and ordered him to pay P20,000 fine for not registering his business and employees with the Social Security System (SSS).
Judge Virginia Hofileña-Europa found Josefino C. Ammalingan, proprietor of Allied Fine Craft located at Medalla Milagrosa in Diversion road in Buhangin, Davao City, guilty of violating the Social Security Act of 1997.
Ammalingan denied the accusation during arraignment, saying he does not have employees.
The Department of Labor and Employment did not find any violation of labor standards during its inspection and the two persons there attested they were not employees, even showing their SSS identification cards classifying them as "self-employed."
A more thorough investigation, however, showed that the accused has five workers.
It was established during trial that he does employ the people working for him and thus should have registered his company and his workers with the SSS.
