Village chief sued for gun ban violation

THE Davao City Police Office has filed charges against a barangay captain accused of violating the election gun ban this February.

Charged with violation of Section 261 of the Omnibus Election Code was Renie Cadayday Lim, barangay captain of Tamugan in Marilog District.

City Prosecutor Retrina Fuentes found probable cause to hold Lim for court trial based on the joint complaint of Police Superintendent Joseph B. Sepulchre and Police Inspector Clemente Tresfuentes of the Investigation Detection Division of the Davao City Police Office.

In their joint affidavit, the policemen said Lim arrived at their office with some policemen from Marilog around 3:45 p.m. of February 7 to clear his name and shed light on an ambush incident being investigated by the Investigation Detection Division.

They simply asked him if he had a gun, and when he said yes, they asked him to hand this over to them for the moment while he is transacting business with them.

Lim, however, failed to hand over the supporting papers for his gun, thus the filing of the case.

Confiscated from the suspect was an unlicensed .45 caliber revolver with three magazines loaded with 21 live ammunition.

City Councilor Victorio S. Advincula Sr., who stood as Lim's lawyer, posted a bond of P80,000 for his client's temporary liberty.
