Court records showed sometime around August 2003 to October 2005, the accused in conspiracy with the victim's aunt and her live-in partner, used and maintained the victim as a prostitute along Suazo street and near Cogot Restaurant along Quirino Avenue in Davao City.
The aunt of the victim and her live-in partner face the same criminal case but have remained at large.
The girl testified that it was her aunt who first forced her into prostitution. In fact, she met Magnifico through her aunt who met up with the pimp on August 29, 2003 near Cogot.
According to the victim, Magnifico brought her first costumers to her aunt’s house and paid her P5,000 for the first to devirginize her and P3,000 for the 2nd costumer.
The next time she saw Magnifico it was in December when he aunt brought her to Cogot to look for a customer who bought her for P1,000, of which P800 given to her aunt and P200 as her share.
On cross examination, she admitted that from year 2003-2004, she was with "Petra", described as a whorehouse along Suazo street in Davao City and where she earned P1,000-P3,000 per night depending on the number of costumers. She also admitted that in 2003 and 2005, she and several others went with her aunt in Manila to prostitute themselves.
She freelanced for a while along Camus Street near Apo View Hotel before she left for Cagayan de Oro with a friend.
When she returned, she rented a place in Matina Pangi and because she was afraid that she would be found by her aunt and the latter's live-in partner, she went to the Anti-vice section of the Davao City Police Office to ask for help.
She was referred to the Criminal Investigation and Detection Group where her complaint against the three was prepared and filed with the City Prosecutor's Office.
The court ruled that it is clear that the aunt and the pimp procured customers for the victim and exploited of her vulnerability without any participation of the aunt's partner thus the conviction of the pimp.
The case against the victim's aunt and her live-in partner will be archived until they are brought to the jurisdiction of the court.
The accused is also ordered to pay the offended party an amount of P10,000 as nominal damages.
