Monday, August 20, 2007 Prosecutor who junked rape case won't handle refiled one By Rhodamae M. Hernandez
THE rape case filed again against six young men and a woman belonging to prominent families in Davao City will not be handled by City Prosecutor Trinidad dela Torre Cardona who earlier dismissed the charges due to lack of evidence.
Instead, the case will be re-raffled at the City Prosecutor’s Office since it was classified as being a regularly filed case and not one on inquest. Cardona handles inquest cases.
The suspects, Andrew (complete name withheld for being a minor), Jeff Anthony Ho, Kenneth Abad, Carla Marfori and three unidentified men were accused of conspiring in the rape of a teenage student last July 12, this year.
In an affidavit, the victim said she and her friend Marfori were drinking beer in a store along Opal Street in Marfori Heights when the young men whom Marfori earlier talked to gave her a glass to drink that made her dizzy.
She claimed that after that, she was brought to a car where she was raped by the men after the car was driven off somewhere else.
