THE Regional Trial Court (RTC) ordered the rebellion case against militant leaders archived pending their arrests.
RTC Branch 14 Acting Judge Loida Posadas Kahulugan ordered the case archived so that it would not appear pending for an indefinite period of time. The case could not proceed because the accused are at large even after warrants were issued for their arrest some six months ago
The case can be reactivated upon the apprehension of the suspects, added the judge.
Charged with rebellion were Alvin Luque, alias Ka Venus, and Ka Samuel, Rinboy, Bobby, Ronnie, Yokyok, Pipoy, Jordan, Pokpok, Larry, Dodong, Juniel, Rudy, Bonbon and Loreto Palma.
Captain Ramon Torres, intelligence chief of the Army's 73rd Infantry Battalion, filed the rebellion charges against Luque and 14 others for allegedly plotting to overthrow the government and giving financial aid to the NPA's Front Guerilla Unit (FGU) 52 operating in the hinterlands of Paquibato and Marilog districts from 1999 to 2002.
Luque and his co-accused were charged with allegedly agitating the FGU-52 to burn buses, forcibly extract revolutionary "taxes" or contribution from civilians, intimidate security guards, engage in cattle rustling and public alarm and scandal.
