Court records showed that at around 7 p.m. of October 4, 2005, the victim, Tessa (not her real name), was supposed to visit her aunt when she instead went to a videoke house and stayed there for 30 minutes.
She said that when she was about to go home, she was dragged to a hut some half a kilometer away from the videoke house by the accused.
There, she was raped after which the man just told her to go home and not tell her mother about what happened.
The accused, in his defense, claims it was a voluntary act because the victim was his girlfriend for five months and was even willing to marry her before and after the incident. He doesn't intend to marry the woman now, though.
Carpio in his ruling said that in as much as no resistance was offered by the victim and no outcries for help was made during the alleged assault that lasted for one hour, it was apparent that what happened was between two consenting adult.
The prosecution also failed to submit as evidence a medical certificate of the victim to prove she was of unsound mind.
