Wednesday, October 03, 2007 Court orders arrest of man for raping 2 sis-in-law
A 46-YEAR-old man is facing arrest on accusation that he raped two of his sisters-in-law several times.
Based on the warrant of arrest penned by Judge Pelagio Paguican of the Regional Trial Court 11 Branch 8 on July 23, the police are ordered to arrest Eduardo Cañada, 46, resident of Cabaguio, Agdao and reportedly an employee of KLR motorpool in Bugac, Ma-a, Davao.
The case was based on separate complaints of sisters Juvy, 19, and Cecil, 18 (names withheld to protect their dignity).
In her affidavit at the Women and Children's Desk of the Davao City Police Office, Juvy said she was at the suspect's house at around 4 p.m. of January 28 to ask money from her sister.
Juvy said her elder sister asked her to wait until she comes back. While waiting, her brother-in-law told her to find a bath towel inside the bedroom. But as she went inside the bedroom, her brother-in-law pushed her on the bed and at gunpoint forced her to have sex.
Juvy added that the suspect threatened to kill her if she told anybody, especially her sister.
Juvy said this was not the first time the suspect raped her. The first time was when she was still 12 years old. She said it was mid-morning at around 9 a.m. of August 16, 2001 when the suspect raped her while she was taking a bath.
Ignoring his threats, she told her elder sister about it. The sister did not believe her and instead accused her of lying.
In her affidavit, she said she left her sister's house on February 5, 2007.
Meanwhile, another sister, Cecil, said the suspect raped her sometime in February 1999. She claimed she was living with the couple at that time and there were occasions when the suspect would molest her while she was asleep.
Cecil said the suspect did this every morning from Tuesday to Friday at the time she was living with them until she reached third year high school.
Her elder sister also does not believe Cecil's accusations and accused the two of them of making stories.
City Prosecutor Retrina Fuentes found probable cause to hold the respondent for court trial.
The brother of the victims, who requested anonymity, said he wants the suspect arrested and made to face charges.
No bail was recommended for the respondent's temporary liberty. (RCO)
