Tuesday, October 30, 2007 RTC orders arrest of ex-soldier for abandoning child
A RETIRED soldier faces arrest for refusing to give financial support to a child he fathered with a former partner.
Regional Trial Court Branch 33 Judge Wenceslao Ibabao ordered for the arrest of Gabriel Hernandez who was charged for violating Republic Act 9262 otherwise known as the anti-violence against women and children after City Prosecutor Gaye Cañete-Magdagasang found probable cause to hold him for court trial based on the complaint of Jenny (not her real name).
Jenny in her affidavit said she had a child with the policeman, who has refused to honor several arrangements for child support.
In May 2006, she filed charges of non-support at the Provost Marshall, Naval station in Camp Panacan. She further claimed than they came to an arrangement last July 2, 2006 that a total of P150,000 will be deducted from the soldier's retirement benefits that will form his child support. After this agreement was made, she executed an affidavit of desistance to withdraw the case filed with the provost.
She later learned that the soldier already retired and has received his retirement benefits and still she has not received the amount agreed on.
She kept on contacting the man but the latter has refused to answer her calls, thus the filing of the case.
Magdagasang recommended a bailbond of P24,000 for the respondent's temporary liberty. (RMH)
