Initial investigation conducted by PO2 Enrique Ayao of the Toril police station showed that the incident occured at around 3 a.m. while the victim was enjoying his birthday party with his friends at Kabayan Beach Resort in Daliao.

According to his friends, the victim was on his way to buy more liquor at a nearby store when two unidentified men went near him and shot him without any provocation.

Labial's female friend said they were surprised when they saw a small group of kibitzers and was even more astonished when they saw that their friend was the cause of commotion.

Labial, who succumbed to gunshot wounds in the head and several parts of the body, died on the spot while the suspects immediately fled onboard a motorcycle.

One Reymar Hermosisima, an eyewitness who was at the store when the shooting occured, was hit by a stray bullet in the right leg but is declared out of danger after he was brought to the Davao Medical Center.

Police and members of the Scene of the Crime Operatives (Soco) recovered seven empty bullet shells of a caliber .45 gun at the crime scene.
Labial reportedly faces theft charges for stealing telephone cables. His father, Jose, said his son was only implicated. The victim's mother Aurelia pleads with his son's killers to surrender.

"Kung kinsa man ang nagpusil, unta mag-surrender na sila," she said.
The Toril police is still conducting further investigation to identify the suspects. (RCO)
