AFTER a five-month investigation, the City Prosecutor's Office charged a former police official accused by his wife of having an extra-marital affair with other women.
Charged with violation of the Republic Act 9262, otherwise known as the anti-violence against women and children act, was Dexter (complete name withheld to protect the dignity of his wife) after City Prosecutor Samuel Atencia found probable cause to hold him for court trial based on the complaint of his wife, Janice (not her real name).
In her affidavit, Janice said they were married last 1998, adding that the respondent was never loyal to her and even had an illegitimate child with his policewoman mistress.
She said that after the incident, they agreed to dissolve their marital properties but she was instead humiliated on the scheduled signing of the necessary documents.
Janice said her husband threatened her by brandishing his handgun at her in front of his office staff.
She claimed that sometime in September 2004, she was reassigned to Camp Crame after filing for legal separation and went back to Davao on July 2005 after the accused promised that they would settle their family problem. However, she discovered he still continued his affair with another woman and they were living as husband and wife in Vinzon Street in Bo. Obrero.
She said she tried her best to find ways to save their relationship but was instead insulted when she bought new clothes for him. She said there was even an incident when she was fixing their laundry when she saw a picture of his husband and his mistress wearing wedding attire.
She claimed that at around 5 p.m. of December 24, 2005, while they were in her brother-in-law's house to celebrate Christmas, her husband's mistress barged into the house, dragged her husband out, and humiliated her. She said her husband's mistress slapped her but she was able to parry the attack.
She said that on January 17, 2006, she went to the rented apartment of her husband to talk to him but he insulted her. When he heard that she was calling the police, her husband pulled his gun tucked in his waist. She did not allow herself to be threatened so she stayed, prompting Dexter to leave instead.
In March 2006, she said she found a CD inside the old quarters of her husband. When she played it, she was shocked when she discovered that it was an alleged video of her husband and his mistress having sex.
She said that when her husband left for the United States, the latter also neglected his financial obligations to their child.
She claimed that after everything that her husband did to her, she decided to file a case.
Atencia recommended a bail bond of P60,000 for the respondent's temporary liberty.
