The businessman was identified as Danilo Rubio Abellana, 56, resident of Jade Street, Doņa Rosa Subdivision in Toril this city.
Abellana just came from a meeting at the People Law Enforcement Board (PLEB) office at the City Council Saturday morning and was on his way to his lawyer, Alexis Villarente, when gunned down.
The victim's Mazda Forward was cruising along Roxas Avenue corner Padre Zamora Street when the two suspects started shooting at the trader.
Abellana succumbed to two head shots while his wife, Elsa, sustained a gunshot wound in her arm from a bullet that ricocheted from her husband.
It was learned that the couple was with their 7-month-old grandchild when the incident happened. Luckily, the baby was unharmed as Elsa readily secured the baby when the shooting started.
PO2 Michael Uyanguren, Sta. Ana police investigator, said the victim was arrested sometime last year for illegal possession of firearm.
Abellana, however, filed counter charges against the arresting officers saying that the officers do not have a search warrant when they accosted him.
Abellana's case against the officers is being heard by Pleb the SP building where he just came before he was killed.
The policemen accused of illegal arrest are said to be members of the Heinous Crime Investigation Section.
Authorities recovered two empty shells of a caliber .45 pistol at the crime scene.
Uyanguren said one of the angles they are looking into is the possible involvement of the policemen whom Abellana accused before the Pleb.
Other angles being pursued are business rivalry and personal grudges.
The victim's wife revealed that her husband has long been receiving threats from unknown individuals. Elsa added that her husband has also been at feud with his relatives over a land dispute.
Abellana was killed the same way Lintuan was. Two motorcycle riding gunmen were involved and caliber .45 pistol was used. (With Rex C. Otero)
