Batman suspect given until Feb. 11 to defend self

CHIEF City Prosecutor Raul B. Bendigo has set February 11 as the deadline for the broadcaster accused of killing Fernando "Batman" Lintuan to submit his counter-affidavit.

Bendigo is tasked to handle the murder charges at the city prosecution level being the chair of the Department of Justice (DOJ) panel for extrajudicial killings.

Larosa received the subpoena last January 30.

"He will be filing his counter-affidavit after 10 days that he received the subpoena and since na fall ng February 10 ang deadline tapos Sunday 'yan, I am giving him up to February 11," Bendigo told Sun.Star Davao.

The National Bureau of Investigation (NBI)-Southern Mindanao charged Leonilo Besabella Larosa after the 15-year-old witness under the custody of the NBI positively identified him as the gunman.

The witness said Larosa was the person who approached him between 7 to 9 a.m. of December 24 while he was tending to a sari-sari store located at corner R. Castillo Street and Duterte Drive.

The boy further claimed that it was Larosa who killed Lintuan as he drove by in his car.

Larosa was charged earlier with illegal possession of firearms after the search operation yielded a Colt Mark IV series 80, a caliber .38 Super Pistol; four magazines; 32 rounds of caliber .38 ammunition; one magazine pouch; one outside gun holster; and one black clutch bag from his Pajero with plate number LME 239 as a subject of the search warrant issued by the RTC 11 executive judge Isaac Robillo.

Larosa is out on bail for the illegal possession of firearms charges.
