Hearing vs radioman in Batman slay can be reset

CHIEF prosecutor Raul B. Bendigo said the scheduled clarificatory hearing of Leonilo Larosa slated February 27 can be possibly reset if the parties have not received the subpoena.

Bendigo, chair of the Department of Justice (DOJ) panel for extrajudicial killings, earlier issued the subpoena to the National Bureau of Investigation (NBI) executive officer Exzel A. Hernandez and agent, lawyer Arcelito Albao and the counsel of the accused, Paul Montejo, for the clarificatory hearing at 9:30 a.m. of February 27.

Larosa was accused of killing fellow broadcaster Fernando "Batman" Lintuan last December 24, 2007 along R. Castillo Street in Agdao.

Larosa was charged with murder for death of Lintuan after a 15-year-old witness, who is now under the custody of the NBI-Semro, positively identified him as the gunman.

The witness claimed that Larosa was the person who approached him between 7-9 a.m. of December 24 while he was tending a sari-sari store located on the corner R. Castillo Street and Duterte Drive.

The boy added that it was Larosa who killed Lintuan while the latter was driving his green Volkswagen.

Larosa was earlier charged with illegal possession of firearms after a search operation yielded Colt Mark IV series 80, a caliber .38 Super Pistol; four magazines; 32 rounds of caliber .38 ammunition; one magazine pouch; one outside gun holster; and one black clutch bag from his Pajero with plate number LME 239 as a subject of the search warrant issued by the RTC 11 executive judge Isaac Robillo.

Larosa is out on bail for the illegal possession of firearms charges.
