CHIEF Davao City Prosecutor Raul B. Bendigo said Monday's clarificatory hearing on the killing of broadcaster Fernando "Batman" Lintuan would be the last.
Bendigo, who is chair of the Department of Justice's (DOJ) panel for extrajudicial killings, said the three hearings were needed for accused Leonilo Larosa and his counsel, Ramon Edison Batacan, and the complainant National Bureau of Investigation (NBI) to clarify things.
"We still have until April 24 to resolve the case since it is the 90th day after the case was filed. Ako rin naman ang mag (I will still) decide kung kailangan pa (if there is still that need)," Bendigo told Sun.Star Davao.
Bendigo said since the NBI had submitted an affidavit of another witness during the first clarificatory hearing, he will give the accused 10 days to submit his reply.
The witness issued a subpoena and who appeared in Sunday's clarificatory hearing did not point to Larosa as the gunman.
"In her testimony with the NBI, nag ingon siya na dili si Antoc pero wala pud siya nag ingon na si Larosa. Katong nakita niya si Larosa, dili daw to siya mao (she said it wasn't Antoc, but she also didn't say that it was Larosa. When she saw Larosa, she said he wasn't the gunman)," Bendigo said.
Larosa was charged with shooting Lintuan to death on December 24, 2007 after a 15-year-old witness under the custody of the NBI identified him as the broadcaster's assailant.
