THE Regional Trial Court Branch 17 will be handling the case filed against the suspect in the killing of broadcaster Fernando "Batman" Lintuan last December 24.
Judge Renato A. Fuentes is yet to schedule the hearing of Leonilo Larosa after the Department of Justice investigating panel composed of chief City Prosecutor Raul B. Bendigo and prosecutors Retrina Fuentes and Emilio Dayanghirang found probable cause to charge him for the crime of murder.
Larosa, through his counsel Ramon Edison Batacan and Paul Montejo, earlier submitted their motion for reconsideration. It was however denied by the panel and sustained their first resolution of charging Larosa of murder for Lintuan's death.
Larosa was charged based on the affidavit by the witness under the custody of the National Bureau of Investigation who identified him as the gunman three times: first at the NBI office, during the line-up, and third on the clarificatory hearing.
Lintuan was shot dead at close range as he stopped for traffic along R. Castillo Street in Agdao while driving his Volkswagen Beetle from his radio station.
Larosa was earlier charged with illegal possession of firearms after a search operation yielded Colt Mark IV series 80, a caliber .38 Super Pistol; four magazines; 32 rounds of caliber .38 ammunition; one magazine pouch; one outside gun holster; and one black clutch bag from his Pajero as a subject of the search warrant issued by Judge Isaac Robillo.
