Monday, May 12, 2008 Suspect in Batman's slay questions arrest warrant
THE suspect in the killing of broadcaster Fernando "Batman" Lintuan questioned the issuance of a warrant of arrest against him.
In an urgent motion filed with the court, Leonilo Larosa said his arrest was with "serious errors in the finding of facts and irregularity in the application of law".
Prosecutor Emilio Dayanghirang earlier denied the motion for reconsideration, sustaining their first resolution of charging Larosa of murder for the death of Lintuan.
Larosa denied all allegations and said that the National Bureau of Investigation should not have disregarded the two other witnesses who did not point to him as the killer.
Lintuan was shot dead at close range as he stopped for traffic along R. Castillo Street in Agdao while driving his Volkswagen Beetle from his radio station last December 24.
Larosa was earlier charged with illegal possession of firearms after a search operation yielded Colt Mark IV series 80, a caliber .38 Super Pistol; four magazines; 32 rounds of caliber .38 ammunition; and one magazine pouch.
The police also got one outside gun holster and one black clutch bag from his Pajero with plate number LME 239.
The search warrant was issued by RTC 11 executive judge Isaac Robillo. (RMH)
