Court asks fiscal to comment on plea of Batman’s suspect

REGIONAL Trial Court Judge Renato A. Fuentes has given Prosecutor Jofre Saniel 1o days to comment on the “urgent motion filed by the lawyer of the suspect in the murder to broadcaster Fernando “Batman” Lintuan.

Leonilo Larosa, who like Lintuan was a blocktime announcer at dxGO, is the suspect in the killing of Lintuan last December 24 after he was identified by one of three witnesses.

The Department of Justice investigating panel chief city prosecutor Raul B. Bendigo and prosecutors Retrina Fuentes and Emilio Dayanghirang earlier denied the motion for reconsideration, sustaining their first resolution of charging Larosa of murder for the death of Lintuan.

Larosa earlier submitted his motion for reconsideration denying all allegations. He said the National Bureau of Investigation (NBI) should not have disregarded the two other witnesses who did not identify him as the killer.

Lintuan was shot dead at close range as he stopped for traffic along R. Castillo Street in Agdao while driving his Volkswagen Beetle from his radio station.

Larosa was earlier charged with illegal possession of firearms after a search operation yielded Colt Mark IV series 80, a caliber .38 Super Pistol; four magazines; 32 rounds of caliber .38 ammunition; one magazine pouch; one outside gun holster; and one black clutch bag from his Pajero with plate number LME 239.

Fuentes in his order, said after the prosecution will submit its comment or opposition, "it will be considered submitted for resolution." He added: "the action in the case is deferred pending the submission of the said comment or opposition".(RMH)
