THE transfer of the murder case involving a radio broadcaster for the assassination of a colleague to another prosecutor and court does not bother Chief City Prosecutor Raul B. Bendigo a bit.
"We have faith in them and we are not worried about the transfer of the case," Bendigo told Sun.Star Davao.
He added that they have strong and sufficient evidence to stand their ground.
"That's maybe why Judge Fuentes had denied what the defense was asking," Bendigo said in an interview.
Prosecutor Victoriano M. Bello Jr., who will be handling the case filed against the broadcaster accused of shooting to death Ferdinand "Batman" Lintuan in December last year, earlier said that he will just continue what prosecutor Jofre Saniel had started.
Saniel is no longer the prosecutor in charge of the case after Regional Trial Court (RTC) Branch 17 Judge Renato A. Fuentes inhibited and the case was again raffled off to RTC Branch 14 where Bello is the assigned prosecutor.
Lintuan, a broadcaster, was shot to death in the morning of December 24, 2007 while coming out of radio station dxGO in Agdao where he was a blocktimer.
Fuentes has issued a 19-page resolution denying Larosa of his right to bail, saying "there is no irreconcilable inconsistency" between what the young witness said in open court and his sworn statement, and that the two were "complementary with each other."
Larosa, also blocktimer at dxGO, was positively identified by one of three witnesses as the one who shot Lintuan to death.
Larosa was charged with illegal possession of firearms after a search operation yielded Colt Mark IV series 80, a caliber .38 Super Pistol, four magazines, 32 rounds of caliber .38 ammunition, one magazine pouch, one outside gun holster, and one black clutch bag from his Pajero with plate number LME 239, the subject of the search warrant issued by the RTC 11 executive judge Isaac Robillo.
