Prosecutor still has to act on Aussie slay motion

DAVAO City Prosecutor Gemma Dabbay-Tambis has yet to resolve the motion for reconsideration submitted by the suspects in the death of an Australian national after she sustained the case as murder.

"I sustained it last year kasi nagbigay ang CIDG (because the Criminal Investigation and Detection Group gave) ng additional evidence," Tambis told Sun.Star Davao.

Corazon Donato, the victim's former live-in partner, and three men accused of helping her carry out the crime -- Mark John Hanginan, Migueleo Demain, and April Jay Juezan -- were accused of conniving to kill Philip Andrew Aitken.

Aitken was already in early stages of decomposition when found in a shallow grave, around three feet deep, in Donato's house in upscale Guadalupe Village, Lanang last October 20, 2008.

The body was exhumed by CIDG operatives and Davao City Police Office personnel.

The discovery of the victim's body came after one of the suspects invited by authorities for questioning admitted to the murder of Aitken and led them to where the 45-year-old victim was buried.

The accused were also identified by neighbors and a housemaid in their affidavits.
