CHR extends deadline for dad in rape try
THE Commission on Human Rights (CHR) in Negros Oriental extended Friday the deadline for the first municipal councilor of Zamboanguita town to submit his counter affidavit on the alleged rape try of a 16-year-old high school student.
CHR special investigator Jesus Caņete, who is handling the case, left for Cebu Friday, the deadline he imposed for the submission of the reply of Councilor Victoriano Marilla.
In a text message to Sun.Star Dumaguete, Caņete said he will study the gravity of the counter affidavit of Marilla before deciding on whether to file charges before the provincial prosecutors' office.
Marilla went to the CHR office to beat the deadline but found it closed.
Caņete said in case the girl's complaint finds merit, he will file a complaint for attempted rape in relation to the child abuse complaint.
In her three-page sworn statement, Cynthia (not her real name) accused the councilor of attempting to rape her on the morning of April 9 this year. Marilla denied the allegation.
CHR postponed its preliminary investigation last September 29 after the girl's mother became mentally disturbed because of threats.
The alleged victim, along with her father, requested Caņete to moved the hearing on the ground that her mother has become "mentally disturbed" and could not appear at the scheduled investigation.
Caņete said he also reset the hearing after Marilla, the center of the probe, requested to extend the deadline for him to submit his counter-affidavit to the complaint of the minor.
The deadline was supposed to be Friday, October 10. VLC
