City to fine, close establishments without mayor's permits By Syril G. Repe
THE City Government now means business.
It will definitely close all business establishments that operate without a mayor's permit once the Office of the City Mayor issues a closure order, fine operators not less than P1,000 or more than P5,000, or haul them to jail for a six-month maximum stay at the discretion of the court.
The move would be in full force once recently approved Ordinance 61 authored by City Councilor Harrison Gonzales would have completed the legal requirements for its enforcement.
Ordinance 61 amends Section 68 (i) second paragraph of the 1997 Omnibus Tax Ordinance of the City of Dumaguete.
Gonzales explained that, at present, implementing agencies of the City Government are "somewhat stymied" in padlocking establishments without mayor's permits because of the lack of clear-cut provisions.
He said the penal provision of the omnibus tax ordinance that governs the permit needed more teeth such as imprisonment to create a deterring effect.
With the amendment, Section 68 or the provision on mayor's permit fees would now authorize the Office of the Mayor to issue a closure order that would be immediately enforced.
In addition, violators would be fined not less than P1,000 or more than P5,000 or imprisoned for not less than one month or more than six month or both at the discretion of the court.
