Treņas told: Put stop to funeral parlor's operation
RESIDENTS of Alta Tierra Village in Jaro, Iloilo City urged anew Mayor Jerry Treņas to immediately issue a cease and desist order (CDO) to Gegato-Abecia Funeral Homes (GAFH) Inc. after the funeral parlor "openly defied lawful orders."
They told Treņas in their letter received by the Office of the Mayor Tuesday that despite various rulings, including that of the Supreme Court and the Regional Trial Court Branch 34 ordering its owner to stop operations, GAFH is "still operating and openly advertising their services."
In fact, last Sunday, they said, it rendered funeral services as confirmed by witnesses.
The residents are represented by Teresita Dullano and Florencio Yap, chairman and vice chairman, respectively, of the Alta Tierra Village Homeowners Association Inc.
In the letter, they told Treņas they are reiterating their previous communications to him since July 27, 2001 to issue a closure order on the funeral parlor.
They also cited the High Court's decision reversing the order of RTC Branch 29 granting a mandamus compelling the City Government to issue a permit to operate to GAFH and RTC Branch 34's decision dismissing the petition for Writ of Preliminary Injunction against the DENR's Environment Management Bureau and the City Government.
Last December 1, EMB issued a CDO to the funeral parlor for its failure to secure an Environmental Compliance Certificate (ECC). Two days after, GAFH's owner was served a Notice of Revocation of Permit signed by Treņas. The notice also cited the funeral parlor's failure to obtain an ECC.
Moreover, the complainants reminded Treņas that he issued a CDO to Fine Built Construction Corp., considering the operation of the cement batching plant illegal over a violation similar to that of GAFH, the absence of an ECC.
"Likewise, you added that it is the policy of the state to promote health and safety and to enhance the right of the people to a balanced ecology, through proper implementation and strict enforcement of national laws and local ordinances," they further told Treņas. NLG
