Prosecution wants court to quash bail for Muslim suspect in drug charges By Jay Dooma Balnig
THE Iloilo City Prosecutor's Office filed Friday their reply to the opposition of Cairoden Abdullah on the motion to quash his bail previously granted by the court.
Fiscal Thaddeus Guadalupe filed his reply stating that the P200,000 bail bond granted by Executive Judge Rene Hotillo be recalled and effect the immediate arrest of Abdullah because the Muslim drug case is non-bailable.
Earlier, the defense, through Attorney Fortunato Padilla, also filed their opposition to the motion of the prosecution claiming that the bail previously granted by the court could not be revoked anymore for the failure of the prosecution to present evidence during the previous hearing.
The motion to quash bail against Abdullah was filed by the Philippine Drug Enforcement Agency (PDEA) and was later adopted by the prosecution after the said case was properly assigned to Judge Victor Gelveson of Regional Trial Court (RTC) Branch 36.
The prosecution Friday added that after they filed their proper manifestation on the issue pending before Gelveson, the motions are now submitted for resolution.
The motion was on the release of the motor vehicles when the police raiding team confiscated the vehicles of Abdullah, a Honda CR-V and Toyota Fortuner and the second issue is the Motion to Quash Bail for the cancellation of Abdullah's bail.
As the case developed, Padilla has already resigned as Abdullah's counsel after he took over the case when Atty. Juan Senupe quit, thus leaving Abdullah's case unattended with counsel.
