Muslim in drug trade still enjoys freedom despite early ruling By Jay Dooma Balnig
CAIRODEN Abdullah, accused by the Philippine Drug Enforcement Agency (PDEA) for illegal drug trade, continues to enjoy his freedom even if the Regional Trial Court (RTC) Branch 36 cancelled his bail and ordered for the issuance of warrant of arrest against him.
Judge Victor Gelvezon granted the prosecutor's Motion to Quash Bail of Abdullah last December 2005 with attached order saying, "Let a copy of warrant of arrest be issued against Abdullah," until now the issuance of warrant is still in limbo.
Gelvezon ordered for the filing of opposition by Prosecutor Thaddeus Guadalupe for five days to the Motion for Reconsideration of defense counsel Jerome Padios for the said quashing of bail.
The ruling was made during a hearing last Tuesday, January 3.
Gelvezon, in an interview, also added that he couldn't issue a warrant of arrest because another issue was raised by the defense counsel, the Motion to Quash Warrant of Arrest issued by Judge Rene Hortillo that resulted to the said arrest of Abdullah.
The PDEA arrested Abdullah last year after they recovered more than 11 grams of shabu during a search in his house in Barangay Ticud, Lapaz.
The defense claimed that the PDEA had a technical defect in implementing the warrant.
After Abdullah's arrest, Judge Hortillo granted P200,000 bail for Abdullah after the failure of Pdea to appear during the hearing and evidence presentation and the failure of the prosecution to file an opposition.
