Tan wants 5 kids placed in immigration watchlist By Jay Dooma Balnig
CONCHITA Tan, aunt of slain Francisco "Bobby" Tan said she wants the court to issue an order directing the Bureau of Immigration to place her nephew's five kids in their watch list.
She said they should be on the said list until further orders by the court. She added that the court should be advised immediately if there's any attempt made by the Zayco clan to take the minors outside of the country without the court's approval.
The children of Bobby with second wife Cynthia Marie Zayco Tan are now under the custody of the Zayco clan of Kabankalan, Negros Occidental. The minors were taken by the said family a day after their parents and their sister Kathy were buried.
The three were murdered in their Molo mansion in January 8 and Bobby's children from his first marriage, Archie and Jan Michael, are facing double murder and parricide charges because of this.
Face-off
Tan, the Zaycos and the 6th Criminal Investigation and Detection Group (CIDG) will face-off Monday at the Regional Trial Court (RTC) Branch 30 of Judge Adriano Savillo.
The hearing was scheduled based on the petition of Conchita entitled, "In the matter of the application for the issuance of Writ of Habeas Corpus and letter of guardianship over the minors."
Named respondents were Superintendent Renato Gumban and men of the CIDG and Mike Zayco, brother of Cynthia Marie and uncle of the minors.
At around 2:30 p.m., the said petitioner and respondents will meet after proper summons were sent and delivered by the court last week.
Conchita, the petitioner alleged that last Jan. 19, 2006, immediately after the interment of Bobby, Cynthia Marie and Kathy, the CIDG headed by Gumban and Mike Zayco stormed her residence without authority from any court, tribunal, or quasi-judicial agency, and forcibly, unlawfully, and feloniously took the said minors. She further claimed that Mike Zayco is unlawfully holding the minors against their will and depriving them of their liberty, despite the absence of any legal right to do so and in disregard of their being in petitioner's custody since the death of their parents, and even before that.
Preliminary hearing
Aside from the face off at RTC Branch 30, the Iloilo City Prosecutors Office will also hold today and at the same time, the preliminary investigation for the accused, Archie and Jan Michael Tan./JDB
