Prosecutor to rule on Tan massacre case Monday By Jay Dooma Balnig
THE time for Assistant City Prosecutor Jeremy Bionat to release his findings on the Tan massacre case has come to an end after the grace period he sought from the Chief City Prosecutor has lapsed.
Bionat would resolveMonday if the case of double murder and parricide against Archie and Jan Michael Tan be elevated to the court or dismissed for lack of probable cause.
The fate of the suspects in the killing of their father, half sister, and step-mother relies on the hand of Bionat as the prosecutor-in-charge has already terminated the preliminary investigation based on the complaint of 6th Criminal Investigation and Detection Group (CIDG).
After a series of postponement and suspension in the process of investigation, Bionat the other week decided to allow the defense to avail of an extension in the interest of justice as the National Bureau of Investigation (NBI) also conducted a parallel investigation on the killing following the directive of Justice Secretary Raul Gonzalez Sr.
But Bionat fixed the deadline until Monday as he earlier announced that the prosecution is already available for the case resolution as early as March 1.
The NBI is yet to release their investigation result.
Defense counsel Philip Sigfrid Fortun wants the prosecution to include the NBI investigation result with the present facts and evidence of the CIDG.
NBI Director Mario Sison refused to give any comment on how far they are with the probe or when they would release the investigation result.
The prosecution previously stated that with or without the NBI report, they are going to proceed with the termination of the probe.
