SP requests SC to rule on Proclamation 1017's constitutionality
THE Provincial Board unanimously approved Tuesday to forward a resolution to the Supreme Court (SC) requesting it to decide on the constitutionality of Proclamation 1017 issued by President Gloria Macapagal-Arroyo.
Board Member Domingo Oso Jr. said there was a need that the court rules on the validity of the proclamation very soon for future guidance.
Oso added that there is no assurance that the same proclamation would not be reissued in the future. As an effect, the SC should resolve the issue on its constitutionality.
Oso also noted that a case on the constitutionality of the said proclamation is still pending in the SC.
Condemnation
In the board's regular session, majority approved a resolution "condemning the curtailment of the civil liberties of the people such as the freedom of expression and the right to peaceably assemble and strongly urging the present administration to exert earnest effort to ensure that individual's rights under the administration be protected."
Board Member Niel Tupas Jr. said the body should now make a strong statement more than opposing the infringements of the rights provided for by the Constitution.
Tupas entailed that the issuance of Proclamation 1017 causing for warrantless arrests of certain personalities, dispersal of peaceful rallies, censorship of media outlets were just among the acts of the state that is condemnable but not the administration itself.
The conscience bloc composed of board members Bernardo Silla, Macario Napulan and some members of the majority, board members Romeo Palmares and Eric Barbosa objected the same resolution and voted for its non-passage. (LABB)
