Misuse of gov't car a ground for admin case: Legal office By Lory Ann B. Bilbao
PROVINCIAL Legal Office (PLO) Chief lawyer Salvador Cabaluna III said the misuse of a government vehicle can't be considered as a grave misconduct but could be a basis for filing an administrative complaint.
Very recently, the fact-finding committee created by Governor Niel D. Tupas Sr. affirmed that Chief of the Iloilo Provincial Hospital in Pototan Noel Icamina committed misuse of a government vehicle, which required a disciplinary action.
The usage of the van for Icamina's service instead of being an alternate ambulance was one of the complaints raised by IPH's 24 personnel.
The fact finding committee headed by Provincial Planning and Development Office Chief Mario Nillos, in its official report forwarded to the office of the Governor Thursday stated that the Pregio van called and agreed as a government vehicle in the form of an alternate ambulance and service of Icamina was never used as the former and never bore a label implying as such.
Labeling every government vehicle 'for official use only' was contained in the Governor's executive order. Thus, failure of putting the same mark violates the same order. This is besides the misuse of the said vehicle.
Governor Tupas told the media earlier that he will order the PLO to create a committee to conduct further administrative investigation confirming Icamina's guilt of committing poor management resulting to degrading services of the hospital including the said misuse of a government car violating the premises of his executive order.
However, Cabaluna said he has not yet received an order from Tupas regarding the said fact-finding result. He also has no knowledge of the result either.
He said filing an administrative case or not against Icamina, even after the investigation of PLO committee still relies on Tupas, being the executive of the Province.
