Zayco counsel hit Prosecutor office for delay in Tan case

THE counsel of the Zayco family recently lambasted the Iloilo City Prosecutors Office for the "delay in the resolution of the Tan massacre that happened last January 8, 2006."

Lawyer Antonio Zulueta, counsel of Zayco family in Kabangkalan, Negros Occidental, during an interview at the Ninoy Aquino International Airport in Manila, raised this.

The 6th Criminal Investigation and Detection Group (CIDG) has sent a letter to Chief City Prosecutor Efraim Baldago asking the reason for the delay.

Under the normal process, the case must be resolved within 45 days after the preliminary investigation.

In a previous interview with Assistant City Prosecutor Jeremy Bionat, the case in-charge, he said that the findings of the National Bureau of Investigation's parallel investigation with that of the 6th CIDG, delayed their investigation.

It was noted that the affidavits submitted by the children of victims Francisco "Bobby" and Cindy Tan to NBI during the investigation, were also used in Zayco's defense in Petition for Issuance of Writ of Habeas Corpus before the Regional Trial Court.

Thus, the prosecution could not proceed because they are waiting for the court's decision on the case.

"Now that the court has finally resolved the Habeas Corpus case, then we can now proceed to the massacre case," Bionat said.
