Charges v. Tans based on speculation--lawyer

LAWYER Hans Sayno, counsel for accused Archie and Jan Michael Tan said Monday that the charges filed against his clients were all based on speculation.

Sayno said this after filing the petition for review before the Department of Justice (DOJ) in Manila and Motion for Judicial Determination of Probable Cause before the Regional Trial Court Branch 32.

Sayno added that until now, he is not convinced there are sufficient pieces of evidence established against his clients.

Based on the evidence submitted by the 6th Criminal Investigation and Detection Group, no evidence has been turned over to the Iloilo City Prosecutor's Office, according to Sayno.

He added that even on the affidavits of witnesses, no one pinpointed the brothers as responsible for killing their father Francisco "Bobby" Tan, stepmother Cindy, and stepsister Kathy on January 8, 2005.

"There is no evidence that could directly link (the crime) to my clients," Sayno added.

Recently, Sanyo filed a motion for suspension of proceedings before the sala of Judge Narciso Aguilar while the petition for review is still pending at the DOJ.

As of now, the court has not issued a warrant of arrest for the Tan brothers.
