Demands to sue contractor will just be ‘noted’: Councilor

LAWYER Romeo P. Gerochi asked that the City Government, through Mayor Jerry P. Treñas, sue the Pavia Housing Project contractor Ace Builders and Enterprises (ABE) for breach of contract, but, it will just be noted down, said City Councilor Perla Zulueta.

Zulueta reminded the local media that Treñas did not listen to a resolution passed by the City Council and authored by Councilor Jed Mabilog recommending a non-appropriation of the City Government for the endorsed P14 million more payment to ABE.

The Committee members as well as the City Councilors saw no valid reason to do so.

Gerochi, “as a resident and taxpayer,” has written to the City Government for the same for four times.

The first was in September 2003, March 4 and 14 in 2005 and the most recent is this month's letter, which demands that the City sue ABE for "using substandard materials and abandonment of the Pavia Housing Project" within 15 days from receipt of the letter otherwise, "we will be constrained to file again another case against you."

Gerochi stated that another criminal charge for violation of Presidential Decree 1979 shall be filed against the City Government when it fails to sue the contractor for breach of contract.

Like any other matters, it will just be "noted down" said Zulueta.

This is despite the referral of the letter by the Council to the City Legal Office.

Gerochi reminded that the City Government already has a pending case before the Office of the Ombudsman.

He filed for the City Government’s violation of the Provisions of the Presidential Decree 1759 on Sections 1 and 2 after its "non-action on my first letter.”
