State lawyers urge SC to junk dismissed exec's suit By Benjamin B. Pulta
GOVERNMENT lawyers have asked the Supreme Court to junk a suit filed by a former labor official questioning his dismissal by Malacñang for sexual harassment.
In a 38-page comment, the Office of the President (OP) urged the high court to dismiss for lack of merit the petition filed by former National Labor Relations Commission (NLRC) Chair Rogelio Rayala.
Rayala had been dismissed from service by former Executive Secretary Ronaldo Zamora in an administrative order (AO 119) after he was found guilty of the "grave offense of disgraceful and immoral conduct."
Rayala elevated the case to the SC after a committee formed by the Department of Labor and Employment (DOLE) at the time recommended his suspension for six months.
The complaint was originally filed against Rayala by stenographer Ma. Lourdes T. Domingo, a member of Rayala's staff, on November 16, 1998.
The victim in her allegations claimed that Rayala would routinely speak to her lewdly and put his arm on her shoulder and squeeze it.
At one time, Domingo claimed Rayala gave her P3,000 for her to go back to school, which she initially accepted but later on decided to return.
