Gil wants canvassing of votes stopped By Benjamin B. Pulta
DISQUALIFIED presidential candidate Eddie Gil Monday asked the Supreme Court (SC) to stop the canvassing of votes cast for president last May 10.
In a 16-page omnibus motion, Gil alleged that there was a failure of election because the Commission on Elections (Comelec) took his name off from the list of qualified presidential candidates even if the SC's April 27 ruling has yet to become final and executory.
The SC ruled last April 27 that the Comelec made no mistake in disqualifying Gil from the presidential race for being a nuisance candidate.
"Without the name of movant Gil being included in the list of candidates for president while he is still on the running as presidential candidate, the people were deprived of their right of choice for presidential candidate," Gil said in his motion.
Gil also said in striking his name off from the list, the Comelec has deprived him of his Constitutional right to suffrage.
Gil also questioned the legality of a Comelec advisory published on May 9, 2004 wherein the commission said a vote for "Bro. Eddie or Eddie" shall be a vote for Jesus is Lord Movement leader Eduardo Villanueva.
He pointed out that on April 13, 2004, the SC directed the Comelec to observe the status quo prevailing before he filed his petition assailing the commission for disqualifying him, meaning he is still qualified to run for president.
The Comelec has said their ruling on Gil's disqualification already became final and executory before the latter filed a petition before the SC so Gil could no longer continue with his campaign.
Gil said even if the SC did upheld last April 27 the Comelec's ruling, such decision would attain finality, if not appealed, by May 14, 2004, well after the elections.
