General in graft case appears before judge advocate

EMBATTLED Army Major Gen. Carlos Garcia appeared Wednesday before the Judge Advocate General's Office (Jago) in Camp Emilio Aguinaldo, Quezon City for a pre-trial with regard charges of alleged violation of two provisions of Articles of War filed against him.

He however did not submit his counter-affidavit and instead asked the Jago to give him another five days as he is still looking for lawyers to prepare his answers.

Jago executive officer and concurrent Armed Forces Justice Division Chief Al Perreras gave Garcia until Monday to respond.

Failure to do so, Perreras said, shall be deemed as a waiver of Garcia's right to submit controverting evidence.

Garcia showed up at the Jago at 10 a.m. and stayed for at least 10 minutes after which he went back to his quarters at 22 Gallego Street in Camp Aguinaldo.

Garcia is facing charges of violation of Articles of War 96 or conduct unbecoming of an officer and a gentleman and Articles of War 97 or prejudicial to good order and discipline.

He is charged for "knowingly, wrongfully and unlawfully" failing to declare all his existing assets in his sworn Statement of Assets and Liabilities (SAL).

Among the assets supposedly not declared by Garcia in his SAL are money with the Armed Forces Police Savings and Loans Association Inc. (Afpslai) worth P6.5 million and cash dividends received from Afpslai from 2002 to 2003 worth P2.8 million.

He also did not declare his unspecified peso and dollar accounts with Land Bank of the Philippines (LBP), Allied Banking Corporation (Alliedbank), Banco de Oro, Universal Bank, Bank of the Philippine Islands (BPI), United Coconut Planters Bank (UCPB) and Planter's Development Bank (PRB).

Garcia also did not state in his SAL motor vehicles registered under him and his wife's name, which are a Toyota car (PEV-665), a Toyota Previa (UDS-195), a 1997 Honda Civic (FEC-134), a 1997 Mitsubishi L-300 van (FDZ-582), and a Toyota RAV 4 (FEV-498).

His acquisition and possession of an immigrant/permanent resident of the United States of America status is included in the charges for violation of a policy governing public officers. (JFF)
