Court orders arrest of Davao Sur mayor

BAGUIO -- A town mayor of Davao del Sur was ordered arrested by the Regional Trial Court (RTC) for allegedly issuing five "bouncing" checks with a total amount of P607,500 as payment for debts he incurred from an Australian national during the 2001 elections.

RTC Branch 14 Judge William Layague issued the warrant of arrest against Alex Wangcay, mayor of Jose Abad Santos town in Davao del Sur for pending charges of five counts of estafa.

Wangkay was charged based on the complaints lodged before the City Prosecutor's Office by Anthony George Stanbridge of 109 Lancer Street, Executive Village, Matina, Davao City.

Stanbridge alleged that Wangkay issued him the following Metrobank checks: for P200,000 on November 20,2001; for P105,000 on December 20, 2001; for P200,000 on January 10, 2002; for P52,500 on January 20,2002, and P50,000 on February 1, 2002.

Stanbridge claimed Metrobank dishonored the five checks because Wangkay's account was already closed.

Wangkay also failed to make good on the checks even after repeated demands.

In his final demand notice dated March 6 this year, Stanbridge is demanding payment for the five checks with an additional P125,000 that Wangkay borrowed from him, 10 percent of the sum for attorney's fees, plus a 12 percent interest per annum from the time the checks became due.

City Prosecutor Raul Bendigo forwarded the charges to the RTC based on the resolution penned by City Prosecutor Efren B. Cachuela who held that Wangkay's issuance of the checks in exchange for monetary value despite knowing that his account was already closed constitute deceit.

Layague fixed the bail bond at P240,000.
