DOJ orders brandy, ad maker to answer raps

MANILA -- The Department of Justice (DOJ) has subpoenaed officials of a distillery firm and an advertising agency after being charged with child abuse for allegedly coming out with a suggestive and an indecent advertising campaign in its "Kinse Anyos" Napoleon Brandy.

In a briefing, acting Justice Secretary Merceditas Gutierrez said the DOJ investigating panel, headed by State Prosecutor Lilian Doris Alejo, has given the officers of Destileria Limtuaco and ad agency SLG until
March 31 to file their counter-affidavits.

She said the subpoena was issued following the filing of a case against the brandy manufacturer and the advertising agency for violating provisions of Sections 5, 9, and 10 of Republic Act 7610 or An Act
Providing for Stronger Deterrence and Special Protection Against Child Abuse, Exploitation and Discrimination by a group of lawyers and child advocates.

Named respondents in the complaint were Julius Limpe, Lily Limpe, Betty Limpe Ngo, Bessie Joy Limpe, Olivia Limpe Aw, Pastor Burgos and Lourdes Galang, all directors and officers of Destileria Limtuaco, manufacturer of Napoleon Brandy.

Also named respondents were Romy Singson and Jake Tadena, president and general manager of SLG advertising agency.

Aside from lawyer Katrina Legarda, a known advocate of the rights of women and children, the other complainants were Ray Salvosa and Maria Isabel Ongpin from the private sector, and lawyers Minerva Ambrosio and Eric Mallonga.

In their three-page complaint, Legarda and company said the huge advertising billboards erected in Quezon City at the corner of Edsa and East Avenue, and on Roxas Boulevard, Paranaque, prominently displayed the words "Nakatikim ka na ba ng kinse anyos?" which they said suggests to the ordinary reader the question, "Have you tried [or tasted] a 15-year-old?"

According to Legarda, the double meaning of the advertising click offers a child to the public in an indecent, suggestive, obscene and pornographic manner, which violates Sections 5, 9 and 10 of RA
7610, and Article 201 (2) of the Revised Penal Code.

Also, the complaint also hit the radio ads aired on several radio stations for the "obnoxious, depraved and vulgar advertisement where a suspicious wife, when confronting her husband as to his late nights, was shocked when he said it was owing to a 'kinse anyos' [a 15-year-old]."Sun.Star Manila
