Actress faces P6.76M tax evasion case

MANILA -- "Movie princess" Judy Ann "Juday" Santos is facing a P6.76 million tax evasion suit before the Department of Justice (DOJ).

Officials of the Bureau of Internal Revenue (BIR) filed Thursday a case against Santos, saying she did not declare all of her income.

BIR Commissioner Guillermo Parayno said that in 2002, Santos under-declared earnings in her income tax return by claiming she received talent fees of P8 million from ABS-CBN television network instead of P11 million.

Parayno said a certification from Viva Productions Inc. confirmed the actress also earned P2.3 million in talent fees for the same year. Star Cinema, a sister company of ABS-CBN, also declared they paid Santos P815,000 for various projects she did with the film outfit, he said.

"The income we confirmed to have been paid her by ABS-CBN and the two film production companies totaled P14.8 million. It is clear that she (Santos) failed to declare in her income tax return for 2002 the amount of at least P6.76 million," he said.

Parayno said the undeclared amount of P6.76 million represented 84 percent of her total income. Not declaring it was a gross violation of a tax code provision saying 30 percent of income not declared constitutes prima facie evidence of false or fraudulent return, Parayno added.

He added that Santos's P14.8 million-income in 2002 does not include the talent fees she received from other sources, such as her endorsement for the political bid of Senator Jamby Madrigal. Santos also had product endorsement contracts for 555 Sardines, Leonardo Bags, Angel evaporated milk, Fitrum, Piltel, AMA Computer Learning Center, Pacific Blue Shades and San Miguel Beer.

Another actor facing a tax evasion suit is Richard Gomez. He submitted his counter-affidavit to the Quezon City Prosecutor's Office to the case filed against him by the BIR, according to Assistant Chief State Prosecutor Richard Anthony Fadullon.

Gomez denied allegations made by the BIR that he under-declared his income for 2003 amounting to P100 million. (Benjamin B. Pulta)
