Ex-village chief backers picket Justice Hall

DAVAO CITY -- Supporters of Roberto Olanolan, one time chief of Barangay 76-A, picketed the Hall of Justice in Matina Wednesday to protest a decision dismissing the civil case he filed against three officials in line with his battle to get back leadership of the village.

Olanonan's supporters brought with them streamers that asked Mayor Rodrigo R. Duterte to release their salaries.

Regional Trial Court Branch 16 Judge Emmanuel Carpio, the judge who ruled on the case and the subject of the picket, brushed off the protests.

"I am not bothered at all by their protest actions," Carpio said, insisting that the dismissal of the civil case was done within the bounds of law and that it was not biased as claimed by Olanolan's supporters.

Olanolan earlier sued City Administrator Wendel Avisado, City legal Officer Melchor Quitain, and City Accountant Rizalina Justol for refusing to recognize him as the village chief of Barangay 76-A and refusing to release government funds to him.

The problem started when the Supreme Court ruled several months ago that Celso Tizon and not Olanolan is the legitimate barangay captain of 76-A.

Olanolan has been contesting this and has been saying he never received a copy of this decision.

Mayor Duterte, however, said in the past months that because the Supreme Court already decided on the case, then City Hall would abide by the decision and would no longer recognize Olanolan as village chief.

Government funds and assistance for 76-A will be coursed through Tizon.

As a result of this stance, City Hall has stopped recognizing Olanolan as the barangay captain, prompting him to file a civil case that Carpio just recently dismissed.

Olanolan has already filed a motion for reconsideration insisting Carpio erred in dismissing the case since the court's intervention is badly needed in the ongoing dilemma, adding that as a result his barangay personnel have not been receiving their salaries and honoraria for five months now.

While seeking the court's intervention, Olanolan has repeatedly been quoted as saying that he does not recognize the Supreme Court's ruling, which happens to be the highest judicial body over and above the lower courts. (JGR of Sun.Star Davao/Sunnex)
