BAGUIO CITY -- Mayor Braulio Yaranon said Sunday he intends to file plunder charges against Representative Mauricio Domogan and Jadewell Parking Corporation.

Yaranon said his plan to lodge the case is an offshoot of the recent filing of an administrative complaint by the Commission on Audit (COA) against Domogan and past and present officials and department heads of the City Government.

He said the COA complaint is insufficient as it dwells only on the determination of the City's share from the parking firm's operations.

Yaranon said the plunder charge would focus on alleged "money changing hands" on the approval of Jadewell's contract. "They gave the contract to an entity that is not entitled. It is a private entity. It should not be allowed to collect public revenue," he said.

Domogan, meanwhile, declined to comment on the mayor's plan, saying he would answer the complaint once it is formally filed.

"What can we do if that's what makes him happy? But what plunder is he talking about? It's a pity to our city that we have a City executive like him (Yaranon)," he said.

Plunder is a non-bailable offense punishable by life sentence or the death penalty.

Republic Act (RA) 7080 provides that any public officer who, by himself or in connivance with members of his family, relatives by affinity, consanguinity, business associates, subordinates or other persons, amasses ill-gotten wealth through a combination or a series of overt or criminal acts in the aggregate amount of at least P50 million shall be guilty for plunder.

The law also punishes those who participated with the public officer in the commission of the offense. (Sun.Star Baguio/Sunnex)
