Arrest order out for anti-drug officer
DAVAO CITY -- A local court had issued the arrest warrant for an official of the Philippine Drug Enforcement Agency (PDEA) in General Santos who was charged with murder over the death of a gasoline station operator in Toril, Davao City last February.
Regional Trial Court Judge Virginia Hofileña-Europa released the arrest order Wednesday against Police Inspector Victoriano Bato Lumbayon, a PDEA officer at Camp Lira in General Santos City.
The arrest warrant was issued because the court cannot act on the urgent omnibus motion since the accused has not yet been under its jurisdiction.
The case against Lumbayon was filed by Nellie Lim, 47, and wife of slain victim Ronald Lim, residents of Saavedra Street in Toril, this city last October 2. The couple owns the Caltex gasoline station located at Crossing Bayabas in Toril.
In her affidavit, Nellie said she coordinated with the elements of the Davao City Police and identified Lumbayon through a cartographic sketch.
At around 1 p.m. last February 3, Nellie said, her husband and son Ronald Nielsen Lim were at their station's garage playing with a remote-controlled airplane toy when a man, later identified as Lumbayon, approached the victim and shot him in the head.
Nellie added that the gunman left onboard a motorcycle with another unidentified man.
Nellie brought her husband to the Davao Doctor's Hospital but he died after a few minutes.
Meanwhile, Nellie's son agreed that the man who approached and shot his father was the one he saw in the cartographic sketch.
Several weeks after Lim's death, Mayor Rodrigo R. Duterte was heard to have said that two police officers were involved in the murder with Lumbayon as their accomplice.
It was further said the murder has something to do with the huge amount of money that the mastermind got from Lim.
Prosecutor Samuel T. Atencia, who earlier recommended the filing of charges, did not set any bail bond for the suspect's temporary liberty. (JGR of Sun.Star Davao/Sunnex)
