Appellate tribunal explains order v. Lanao guv's suspension (10:32 a.m.)
MANILA -- The Court of Appeals has clarified that the status quo order it earlier issued would indeed stop the implementation of a suspension order the Office of the Ombudsman earlier issued against Lanao Del Sur Governor Bashier Manalao.
Manalao's suspension order was issued last October 28 after several months of review by the Ombudsman of cases filed against the governor by the majority bloc of the Lanao del Sur Provincial Board (PB) over alleged grave abuse of authority and nepotism.
The camp of Vice Governor Monera Macabangon earlier claimed that the status quo order would in fact work in their favor and that she should assume as acting governor after Manalao's suspension.
But in an oral argument held recentlyby the CA's 15th Division Associate Justice Noel Tijam stressed that the status quo order is self-explanatory.
He said that "in effect, the status that would be imposed is the status before the imposition of the suspension", hence it would favor Manalao.
The CA is also hearing Manalao's application for a permanent injunction, asking that the Ombudsman be restrained permanently from implementing its suspension order. (ECV)
