High court declares emergency rule 'partly legal' (4:04 p.m.)

MANILA -- The Supreme Court (SC) reportedly declared Proclamation 1017 as "partly constitutional and partly unconstitutional".

An ABS-CBN News Channel report said the SC en banc, in its session in Baguio City, said the declaration of a state of emergency by President Gloria Macapagal-Arroyo last February 24 was within the bounds of the 1987 Constitution.

Its application however was declared illegal, referring to the warrantless arrests and the raid on the Daily Tribune, a newspaper critical of the government.

SC spokesman Ismael Khan is expected to give a press briefing on the decision.

Various groups had questioned Proclamation 1017, which Arroyo lifted on March 3, following an aborted coup attempt. (Sunnex)
