Transport agency chief sues radioman

DAVAO CITY -- The Land Transportation Office (LTO) regional director accused a radio anchorman of maligning him on air and filed five counts of libel against the broadcaster.

Nestor "Estong" Caballes of ABS-CBN's dxAB AM radio was charged by LTO Director Gomer J. Dy for the alleged "malicious and false imputations" that Caballes uttered against Dy in the radioman's program Fuego Todo aired from 1 to 3 p.m. everyday.

In his affidavit of complaint, Dy said Caballes started his verbal attacks on him in January 2007 in relation to a pending case involving Loreto Hao and Zenaida Silver.

The case revolved around the reported controversial ownership of used imported vehicles irregularly registered with the LTO Bislig District Office without the required Certificate of Stock Reported (CSR).

At 2:30 p.m. on February 12, in the same program, Dy said Caballes accused him of receiving a Sportage vehicle from Hao as bribe.

He then asked his staff to call up the station so that he can explain his side, saying he legitimately bought the Sportage in 2002, way before the controversy broke out in 2005.

Dy said he even told Caballes during that phone call to verify his reports before airing them and that a case about this was still pending at the Ombudsman-Mindanao.

Despite his explanation, he said Caballes again maligned him at around 1:30 p.m. on March 6 and on March 7, again in the same program.

Caballes repeated this claim at around 6:45 a.m. on March 8 during the radio program "Banat," a portion of which was aired in a live telecast in Maayong Buntag Mindanao.

According to Dy, Caballes repeated the claim again on March 12.
