Businessman, wife charged with tax evasion By Dante M. Fabian
ANGELES CITY --- Clark International Airport Corporation (CIAC) chairman Nestor Mangio, his wife, and officials of the San Fernando register of deeds are facing administrative and criminal charges for tax evasion involving at least P68 million.

The tax evasion charges are in relation to the transfer of lands that are now part of The Lakeshore subdivision in Mexico town.
The top man of The Lakeshore and his co-respondents were also charged with falsifying deeds of sale purporting the sale of properties owned by former Provincial Board member Roberto David and transfer of ownership to Mangio and his wife.
The separate criminal and administrative complaints were filed before the Land
Registration Authority (LRA) and the Office of the Ombudsman by former Pampanga PB member Robert David against Mangio, his wife Marion, San Fernando register of deeds Lorna S. Dee, and her deputy Enrique Basa.
The complaints were filed this week with the offices of Benedicto Ulep, LRA administrator, and Ombudsman Merceditas Gutierrez.
In the cases filed by David through legal counsel Nicholas Aquino, Mangio, Dee, and the other respondents were charged with violating the Anti-Graft and Corrupt Practices Act.
The respondents were accused of conspiring with each other to defraud government by evading the payment of capital gains tax, documentary stamps tax, transfer taxes, and registration fees in the estimated amount of P68 million.
The amount includes the interest, penalties, and surcharge in the alleged illegal and fraudulent sale of a parcel of prime land with a total area of 59,675 square meters in The Lakeshore subdivision in Mexico, Pampanga.
David's affidavit is accompanied by documentary evidence to prove his allegations. Among his documents are the Certification from the Revenue District Office of BIR, Pampanga; Certification from the Bureau of Immigration; copy of the Certificate of Titles in the name of David; copy of the certificate of titles in the name of respondent Mangio, Marion; abstract of the Philippine Passport of Robertto R. David; Certification from the Office of the Executive Judge of the Regional Trial Court of San Fernando, Pampanga.
David complained that Mangio and the other respondents conspired in the falsification of three deeds of sale covering landholdings that belonged to him.
David contends that he could not have possibly signed the deeds of sale purportedly executed on February 2, 2004 since he was in the United States on that date.
In his affidavits, David said that in the three "falsified" Deeds of Absolute Sale, respondents made it appear "that I sold the parcels of land" to respondents "spouses Nestor Mangio and Marion P. Mangio for a very minimal consideration of P100,000 only."
"Respondents then made it appear that I affixed my signature on the said falsified Deeds of Absolute Sale on February 2, 2004, by forging my signature on top of the typewritten name Roberto David on the said document."
David further said the respondents also made it appear that he was there before Notary Public Crescente M. Caladiao on that day and acknowledged the alleged falsified Deeds of Absolute Sale.
He complained that the three falsified Deeds of Absolute Sale were all recorded in the notarial book of Notary Public Crescente M. Caladiao.
"An examination of the three falsified Deeds of Absolute Sale would clearly show that the signatures of Notary Public Crescente M. Caladiao appearing on the said falsified documents have marked differences indicating that they were also forged," the complainant added.
He said Caladiao was also not duly commissioned as notary public of San Fernando for 2004 as shown by a certification issued by the Office of the Executive Judge of the Regional Trial Court in San Fernando, Pampanga.
The Lakeshore boss denied David's allegations in a statement issued by the Central Country Estates Incorporated that manages The Lakeshore.
Carlo Jimenez, CCEI public relations officer, said Mangio denounced in strongest terms the false accusation made against him by David.
