CDC continues Bayanihan Park construction By Dante M. Fabian
CLARK ECOZONE -- The Clark Development Corporation (CDC) is determined to finish the P50-million development project on Bayanihan Park here as scheduled despite efforts by Angeles City Government officials to assert the City's jurisdiction over the area.
Angeles City officials earlier announced that they will assert the rights of the City over the current development activities on the park.
CDC officials said the P50-million park redevelopment project is financed by the Premier Central Incorporated headed by Chinese taipan Henry Sy as a freebie in exchange for its long-term lease for its SM Clark project approved last year.
Pepito Galang, CDC vice president for operations and technical services, said earlier that the development on the 12-hectare Bayanihan Park will cost P50 million.
Galang said the issue of jurisdiction on the park is now being studied by the state-run corporation's legal office.
Galang said the CDC will come up with its reaction soon after this is released to CDC officials by lawyer Jose C. Lukban, CDC legal department head.
Galang said this in reaction to reports that Mayor Carmelo "Tarzan" Lazatin is bent on asserting the City's right to impose its local ordinances and regulations over the ongoing development on Bayanihan Park.
City Administrator Alberto M. Suller announced last Wednesday that a stoppage of construction work by the contractors will be imposed by the City should they refuse to comply with the local government's requirements.
Suller said Lazatin ordered the city engineer to require the contractors of the park to secure building permits and clearances from the City Government in accordance with an opinion released earlier by Arvin Suller, city legal officer.
Galang added that the construction activities on Bayanihan Park will continue as CDC will be firm in its completion by December 15.
Galang also said 164 stalls being constructed along the Fields Avenue side of the park will also be finished by November 30.
Galang said Emmanuel Y. Angeles, CDC president, and the directors of the board planned to award the stalls to provide the displaced occupants with the chance to resume their livelihood activities in the park.
Suller said he has instructed city engineer Donato Dizon to inform the management of New City Builders Incorporated, the Bayanihan Park general contractor, of their legal obligations relative to the project.
Suller said should the said contractors and their sub-agents fail to comply with the requirements, the City Government shall be constrained to cause the discontinuance of the construction activity at the park.
Suller said based on the opinion issued by the city legal officer, the present construction at the Bayanihan Park is illegal and may be stopped by the City.
The city legal officer said it must be remembered that Republic Act 7227, otherwise known as the Bases Conversion Law that created the Bases Conversion and Development Authority (BCDA) and the Clark Special Economic Zone, mandates that coordination and consultation with the local government concerned must be observed.
