Illegitimate kids can now use dad's surname By Reynaldo G. Navales
CITY OF SAN FERNANDO -- Illegitimate children may now use the surnames of their fathers.
This is provided for under Republic Act (RA) No. 9255 amending Article 176 of Executive Order No. 209, otherwise known as the Family Code of the Philippines.
However, the same law states that a father has to acknowledge the child who wishes to use his parent's name.
In a press statement, National Statistics Office (NSO) Administrative Officer Carina R. Miranda said RA 9255 applies to all illegitimate children born before and after its effectivity.
The law was signed by President Gloria Macapagal-Arroyo on Feb. 24, 2004 and took effect on Mar. 19, 2004, 15 days after it was published on Manila Times and Malaya.
The implementing rules and regulations of the law, on the other hand, were issued on June 2, 2004.
Miranda said a father could recognize his child through a "public" or "private" document. It may be the affidavit found on the back of certificates of live birth, a separate public document executed by the father, or a privately signed handwritten instrument recognizing the child as his.
